Your Will can be a part of our future
We would be honoured if you would consider The Maltings when drawing up your will.
Why your legacy will make a difference
The Maltings does so much more than provide entertainment. It not only gives local people a chance to experience high quality cultural events, it reaches out to young people and involves them in dance and drama workshops.
It provides opportunities for aspiring young artists and supports a wide variety of community arts initiatives – both amateur and professional - in the North East and the Borders.
You can help ensure that this work continues as part of your legacy.
The following information explains how you can leave a gift for the Maltings after all your loved ones have been provided for.
Even a small specific donation would help make sure that future communities in our area will continue to be able to enjoy good theatre and experience the joy that expression through the arts can bring.
How do I go about making a will?
Making a Will is not expensive, complicated or time-consuming. There are ‘over the counter’ templates for homemade wills available in many shops but these can lead to problems which are expensive to address and cannot always be rectified when important details are left out or the will is deemed invalid.
We would strongly recommend going to a solicitor for professional, reliable advice in drawing up your will. The cost is usually under £100. The following guidelines will help you prepare the necessary details and keep the expense to a minimum:
- Work out the sum of your estate by listing all your assets (house, savings, jewellery etc) and subtracting all your liabilities (mortgage, debts etc). The result is how much your estate is worth. Next, decide how you would like your assets and possessions to be divided amongst your family and friends. If at this point you do decide to leave a legacy or gift to the Maltings (Berwick) Trust or any other cause, there are different ways you can do so.
- A pecuniary legacy - a gift of a fixed sum of money to a named person or organisation.
- A specific legacy - A gift of a particular item (not money), such as jewellery to a named person or organisation.
- A residuary legacy - After all pecuniary and specific bequests have been made and your expenses accounted for, the remainder of your estate is known as the residue. If this is not covered by a Residuary Bequest the law determines what happens to it. The residue can be split between family, friends and your favourite causes.
What if I already have a will?
It is very important to keep your will up to date. Altering an existing will can be done simply by adding a codicil. This is a separate legal document witnessed in its own right. Again, consulting with a solicitor is the best way to add a codicil and ensure it is legally binding. A codicil must be kept with your will but not attached to it.
How do I word a legacy or codicil?
To ensure that no problems arise when the will is executed, the wording used must include the name “Maltings (Berwick) Trust” and our charity number which is 701194.
Below is a suggestion on how to word a legacy, but we do strongly recommend that you also consult a solicitor to ensure that the will is legally binding and that your wishes are carried out, especially where a codicil is concerned.
Pecuniary legacy.
If you want to make a straightforward gift of a fixed amount, set out below is suggested wording your professional adviser can use:
‘I give to the Maltings (Berwick) Trust, Eastern Lane, Berwick-upon-Tweed TD15 1AJ, Registered Charity Number 701194, to be applied for the general purposes of the Maltings (Berwick) Trust the sum of (amount in figures, amount in words) and I direct that the receipt of a proper officer for the time being of the Maltings (Berwick) Trust shall be a complete discharge to my Executors.’
Residuary legacy
Many people choose not to leave a stated sum of money to charity, but rather to leave a share of the residue of their estate. In this case, your professional adviser may find the following wording helpful:
“I give all/a share of (please state fraction/percentage) the residue of my estate absolutely to the Maltings (Berwick) Trust, Eastern Lane, Berwick-upon-Tweed, TD15 1AJ, Registered Charity Number 701194, applied for the general purposes of the Maltings (Berwick) Trust and I direct that the receipt of a proper officer for the time being of the Maltings (Berwick) Trust shall be a complete discharge to my Executors.”
Specific legacy
This is when you want to give a specific item or property, in which case the following wording will be helpful:
I give my (short description of the property given) free of all inheritance tax to the Maltings (Berwick) Trust, Eastern Lane, Berwick-upon-Tweed, TD15 1AJ, Registered Charity Number 701194, applied for the general purposes of the Maltings (Berwick) Trust and I direct that the receipt of a proper officer for the time being of the Maltings (Berwick) Trust shall be a complete discharge to my Executors.”
Scotland
The wording for the above clauses is different in Scotland. If you are making a will under Scottish Law we advise you to consult a solicitor for the appropriate wording.
Tax Implications – your gift is tax free
As the Maltings (Berwick) Trust is a registered charity, no inheritance tax is payable on the amount of your gift, since charities are exempt from paying this tax. The taxable value of your estate is reduced by the amount you donate before tax is applied to any amount above the tax free figure. Thus, it is worth bearing in mind that you can choose either to pay the tax to the Inland Revenue or to a charity whose work you support. As these subjects are complicated and subject to change you should consult a professional adviser for clear advice on this issue.
There are also tax implications in leaving the residue of your estate between charitable and non-charitable beneficiaries. Again, your professional adviser will be able to assist you with this.
Do please do tell us
You are not obliged to divulge the contents of your will or any codicils to anybody (not even those witnessing your signature).

Alternatively, you may wish it to be known that you have made such a decision.
Do you have any questions or want to discuss this?
We will be pleased to respond to any questions you have or generally discuss your needs.
A discussion will also help us understand your wishes and any way in which you may want your gift commemorated.
